IRS No-Signature Form 8955-SSA Filing Extension Guidance


June 20, 2012 –IRS proposed regulations that will permit Form 8955-SSA filing extensions to be submitted without signature is scheduled for publication in tomorrow’s Federal Register. For service providers who deal with many plans that seek filing extensions, this is welcome news.

Form 8955-SSA, Annual Registration Statement Identifying Separated Participants With Deferred Benefits, must be filed in conjunction with Form 5500, Annual Return/Report of Employee Benefit Plan, to report such former employees who have deferred vested benefits under a plan. Existing rules allow Form 5500 submission for an automatic filing extension without signature on Form 5558, Application for Extension of Time to File Certain Employee Plan Returns. Form 8955-SSA automatic filing extensions, however, have required a signed submission.

These proposed regulations will align the rules for Form 5500 and Form 8955-SSA automatic extension submissions (no signature required for either). The change is to be effective as of the date of publication in the Federal Register
